Vibespot Privacy Policy

This Privacy Policy describes how Vibespot, LLC, a Delaware limited liability company ("Vibespot," "we," "us," or "our"), collects, uses, shares, and protects personal information when you use our websites, mobile applications, web dashboard, and related services (collectively, the "Platform").
This Privacy Policy is incorporated into and forms part of our Terms of Use. Capitalized terms not defined here have the meanings given in the Terms of Use. By using the Platform, you acknowledge the practices described in this Privacy Policy.

1. Summary
- We collect the information you give us (such as your account details, the Vibes you post, and the phone number you verify in order to post), information generated by your use of the Platform (such as likes, Points, and device data), and, with your permission, your location.
- We use this information to operate the map, show you relevant nearby Vibes, run the Points and tier systems, keep the Platform safe, and improve our services.
- Vibes you post are public. Location is central to how the Platform works, and you control location permissions through your device and browser settings.
- We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
- You can access, correct, or delete your information, and California residents and users in certain other regions have additional legal rights described below.
2. Information We Collect
Information you provide
- Account information: username, email address, password, and any optional profile details you add (such as a display name or photo).
- Phone number and verification data: to post Vibes, you must verify a phone number. We collect the phone number you provide and confirmation that you entered the one-time code we sent to it by SMS. We use this to deter spam and abuse and to associate posting privileges with a verified number.
- Content you post: Vibes and their details (titles, descriptions, dates, times, locations, photos, links), and any other content you submit to the Platform. Remember that Vibes are public.
- Tier and upgrade requests: information you send us when requesting higher tiers, expanded posting limits, or partnership arrangements, including business or organization details.
- Communications: the contents of messages you send us, such as support requests, feedback, reports of inaccurate listings, and copyright notices.
Information collected automatically
- Engagement and activity data: likes you give and receive, Points associated with your Account and your Vibes, posts, searches, saved items, map areas viewed, and how you interact with features.
- Device and log data: IP address, browser and device type, operating system, app version, device identifiers, language settings, referring pages, access times, and pages or screens viewed. IP addresses also give us a general (city-level) sense of location.
- Location data: described in detail in Section 3.
- Cookies and similar technologies: described in Section 6.
Information from other sources
- Public and partner sources: the Platform displays event and place information gathered from public websites and calendars, Organizers, businesses, municipalities, tourism organizations, licensed datasets, and partner feeds. This is primarily information about events and places rather than about our users, but it may occasionally include publicly available information about individuals, such as a performer's name in an event listing.
- Third-party sign-in: if we offer sign-in through a third-party service and you choose to use it, that service may share information with us such as your name and email address, as permitted by your settings with that service.
3. Location Information
Location is central to Vibespot. We may collect and use:
- Precise location from your device's GPS or similar sensors, only if you grant location permission through your device or browser. We use it to center the map near you, show nearby Vibes, and, for some account tiers, to determine the area within which you may post (for example, mobile accounts that may post only within a small radius of their current position).
- Approximate location derived from your IP address, used to show a relevant map area and for security and analytics.
- Locations you enter, such as map searches, saved areas or cities, and the locations you assign to Vibes you post. The location of a posted Vibe is public, because showing it on the map is the point of posting it.
You can disable location permissions at any time in your device or browser settings. The Platform will still work, but nearby discovery will be less accurate, and features or tiers that depend on verifying your current position may be limited or unavailable.
4. How We Use Information
We use the information we collect to:
- provide and operate the Platform, including displaying Vibes on the map, showing nearby and relevant results, and enabling posting, likes, and discovery;
- administer the Points system and account tiers, including calculating Points, applying posting limits and radius restrictions, and processing tier upgrade requests;
- maintain and improve the Platform, develop new features, and understand how the Platform is used, including through aggregated analytics;
- curate and improve listing quality, including deduplicating, correcting, categorizing, geocoding, and enriching Content, which may involve automated or AI-assisted processing;
- communicate with you about your Account, security, support requests, and changes to the Platform or our policies;
- send marketing communications where permitted by law and subject to your right to opt out;
- verify Accounts, including sending SMS verification codes to the phone number you provide before enabling posting;
- protect the security and integrity of the Platform, including detecting and preventing fraud, spam, Points manipulation, abuse, and violations of our Terms of Use; and
- comply with legal obligations and enforce our rights.
If we introduce paid features in the future, we will also use relevant information to process payments and manage subscriptions, and payment card details will be handled by payment processors rather than stored by us. We will update this Privacy Policy as needed at that time.
We do not use your personal information to make automated decisions that produce legal or similarly significant effects on you.
5. What Is Public on the Platform
The Platform is a public discovery service. The following are visible to other users and the general public:
- Vibes you post, including their locations, details, and photos;
- your public profile information, such as your username, in connection with your posts where displayed; and
- aggregate engagement on Vibes, such as like counts and visibility influenced by Points.
We may also publish or share aggregated or de-identified information (for example, trends about local activity) that does not identify you.
6. Cookies and Similar Technologies
We use cookies, local storage, SDKs, and similar technologies to keep you signed in, remember your preferences, understand how the Platform is used, measure performance, and protect against fraud and abuse. Some of these are set by service providers that help us operate the Platform, such as analytics providers.
Most browsers let you block or delete cookies. Blocking some cookies may affect Platform functionality, such as staying signed in. Where required by applicable law, we will request your consent before placing non-essential cookies.
The Platform does not currently respond to "Do Not Track" browser signals, for which no common standard has been adopted. We do honor opt-out preference signals where required by law, as described in Section 10.
7. How We Share Information
We do not sell your personal information. We share personal information only as follows:
- Service providers: companies that perform services for us, such as cloud hosting, mapping services, analytics, communications delivery, and customer support tools. They may use your information only to provide services to us.
- Partners, at your direction: if you participate in a partnership or city program, we may share relevant information with the applicable partner as disclosed when you enroll.
- Legal and safety: we may disclose information if we believe in good faith that disclosure is necessary to comply with a law, regulation, legal process, or enforceable governmental request; to enforce our Terms of Use; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of Vibespot, our users, or the public.
- Business transfers: if Vibespot is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its assets, personal information may be transferred as part of that transaction, subject to this Privacy Policy or a successor policy of which you will be notified.
- With your consent: in other cases, we will share personal information only with your consent or at your direction.
Public Content, as described in Section 5, is shared with everyone by design.
8. Data Retention
We keep personal information for as long as your Account is active or as needed to provide the Platform. We also retain information as necessary to comply with legal obligations, resolve disputes, enforce our agreements, maintain security, and support routine backups, after which it is deleted or de-identified.
Public listing information that has been merged into the Platform's aggregated event and place data (for example, a deduplicated event listing) may persist in de-identified or curated form after the contributing Account is closed.
9. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and hosting with reputable infrastructure providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your credentials confidential. Please report suspected unauthorized access to your Account to support@vibespot.com, and report security vulnerabilities to security@vibespot.com. If we become aware of a breach affecting your personal information, we will notify you as required by applicable law.
10. Your Choices and Rights
Regardless of where you live, you can:
- Access and update most Account information by signing in to your Account;
- Delete Content you posted, subject to the retention terms in Section 8 and the license terms in our Terms of Use;
- Close your Account by contacting support@vibespot.com, after which we will delete or de-identify your personal information except as retention is permitted or required as described in Section 8;
- Opt out of marketing by using the unsubscribe link in any marketing email, or by emailing support@vibespot.com. You may opt out of SMS messages as described in the Terms of Use. You will still receive administrative messages about your Account; and
- Control location through your device and browser permission settings.
To exercise any privacy right, or to request a copy, correction, or deletion of your personal information, email privacy@vibespot.com. We may need to verify your identity before acting on a request, and we will respond within the time required by applicable law.
California residents
If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) gives you the following rights:
- Right to know: to request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes, and the categories of third parties to whom we disclose it.
- Right to delete: to request deletion of personal information we collected from you, subject to legal exceptions.
- Right to correct: to request correction of inaccurate personal information.
- Right to opt out of sale or sharing: we do not sell personal information, and we do not share personal information for cross-context behavioral advertising, so there is nothing to opt out of. If this ever changes, we will update this Privacy Policy and provide the required opt-out mechanisms, and we will honor recognized opt-out preference signals such as the Global Privacy Control.
- Right to limit use of sensitive personal information: we do not use or disclose sensitive personal information for purposes requiring a right to limit under the CPRA. Precise location, where you enable it, is used only to provide the Platform features described in this Privacy Policy.
- Right to non-discrimination: we will not discriminate against you for exercising your privacy rights.
In the preceding 12 months, we have collected the categories of personal information described in Section 2 (identifiers; internet and network activity; geolocation data; and content you provide), from the sources described there, for the purposes described in Section 4, and disclosed them for business purposes to the categories of recipients described in Section 7. We do not knowingly sell or share the personal information of anyone, including consumers under 16.
You may submit requests by emailing privacy@vibespot.com. You may designate an authorized agent to make a request on your behalf; we will require proof of authorization and may still require you to verify your identity.
Users in the European Economic Area, United Kingdom, and other regions
If you are in a region whose law requires a legal basis for processing (such as the EEA or UK), our legal bases are: performance of our contract with you (operating the Platform you signed up for); our legitimate interests (improving and securing the Platform, and curating public event and place information), balanced against your rights; your consent (precise location, non-essential cookies, and marketing, where required); and compliance with legal obligations.
You may have the right to access, correct, delete, or receive a portable copy of your personal information, to object to or restrict certain processing, and to withdraw consent at any time without affecting prior processing. You may exercise these rights by emailing privacy@vibespot.com, and you have the right to lodge a complaint with your local supervisory authority.
Vibespot is based in the United States, and we process and store information in the United States and other countries, which may not provide the same level of data protection as your home jurisdiction. Where required, we rely on appropriate safeguards for international transfers, such as the European Commission's Standard Contractual Clauses.
11. Children
The Platform is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact privacy@vibespot.com and we will delete it. Users under the age of majority in their jurisdiction may use the Platform only as described in our Terms of Use.
12. Third-Party Sites and Services
The Platform links to third-party websites and services, such as event pages, venue sites, and ticketing providers. This Privacy Policy does not apply to them. Their collection and use of your information is governed by their own privacy policies, which we encourage you to review.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide reasonable advance notice, such as by posting a notice on the Platform or emailing Account holders, and we will update the "Last Updated" date above. Your continued use of the Platform after the effective date of an updated Privacy Policy constitutes acknowledgment of the update.
